H.L.A. Hart e O Conceito de Direito

Nosso grupo de estudos passará a estudar, nessas férias de verão, a mais importante obra de filosofia e teoria do direito escrita em língua inglesa no século XX: O Conceito de Direito de H.L.A. Hart.
Abaixo, uma descrição da obra:
First published in 1961, The Concept of Law is the most important and original work of legal philosophy written this century. It is considered the masterpiece of H.L.A. Hart's enormous contribution to the study of jurisprudence and legal philosophy. Its elegant language and balanced arguments have sparked wide debate and unprecedented growth in the quantity and quality of scholarship in this area--much of it devoted to attacking or defending Hart's theories. Principal among Hart's critics is renowned lawyer and political philosopher Ronald Dworkin who in the 1970s and 1980s mounted a series of challenges to Hart's The Concept of Law. It seemed that Hart let these challenges go unanswered. However, after his death in 1992, his answer to Dworkin's criticism was discovered among his papers.
In this valuable and long-awaited new edition Hart presents an Epilogue in which he answers Dworkin and some of his other most influential critics including Fuller and Finnis. Written with the same clarity and candor for which the first edition is famous, the Epilogue offers a sharper interpretation of Hart's own views, rebuffs the arguments of critics like Dworkin, and powerfully asserts that they have based their criticisms on a faulty understanding of Hart's work. Hart demonstrates that Dworkin's views are in fact strikingly similar to his own and in a final analysis, Hart's response leaves Dworkin's criticisms considerably weakened and his positions largely in question.
Containing Hart's final and powerful response to Dworkin in addition to the revised text of the original The Concept of Law, this thought-provoking and persuasively argued volume is essential reading for lawyers and philosophers throughout the world.

Q. How do you feel about the aging process?

A. Well, I’m against it. [laughs] I think it has nothing to recommend it. You don’t gain any wisdom as the years go by. You fall apart, is what happens. People try and put a nice varnish on it, and say, well, you mellow. You come to understand life and accept things. But you’d trade all of that for being 35 again. I’ve experienced that thing where you wake up in the middle of the night and you start to think about your own mortality and envision it, and it gives you a little shiver. That’s what happens to Anthony Hopkins at the beginning of the movie, and from then on in, he did not want to hear from his more realistic wife, “Oh, you can’t keep doing that — you’re not young anymore.” Yes, she’s right, but nobody wants to hear that.

A fenomenologia segundo Bunge

Mario Bunge, nascido na Argentina, mas atualmente professor na McGill University em Montreal, é um físico e filósofo da ciência defensor do realismo científico. Sobre a fenomenologia, consta o seguinte verbete em seu Dicionário de Filosofia: "A descrição não científica e a análise da experiência subjetiva, em particular o 'fluxo de consciência'. Especialmente, a doutrina subjetiva idealista de Husserl de que o processo consciente do olhar intro-dirigido é necessário e suficiente para desvendar a essência das coisas. Ele a identifica com a 'egologia' e seu discípulo mais brilhante, Heidegger, tornou-a o ponto de partida de seu enigmático meditar acerca do ser e do nada. Exemplo de prosa fenomenológica: 'Como ego primevo, eu constituo meu horizonte de outros transcedentais como co-sujeitos que estão dentro da intersubjetividade transcedental, os quais constituem o mundo' (Husserl)".
